Terms of Use / Public Offer Agreement

1. General Provisions

1.1. This offer is an official offer of TM "pocketstore.com", hereinafter referred to as the "Seller", to conclude a contract for the sale of goods remotely, that is, through the online store, hereinafter referred to as the "Agreement", and places the Public Offer (offer) on the official website of the Seller pocketstore.com (hereinafter referred to as the "Website").

1.2. The moment of full and unconditional acceptance by the Buyer of the Seller's offer (acceptance) to conclude an electronic contract for the sale of goods is considered the fact that the Buyer has paid for the order on the terms of this Agreement, in the lines and at the prices indicated on the Seller's website.

2. Concepts and Definitions

2.1. In this offer, unless the context requires otherwise, the following terms have the following meanings:

• "Product" - models, accessories, components and related items;
• "Online store" - in accordance with the Law of Ukraine "On Electronic Commerce", a means for the presentation or sale of goods, work or services through an electronic transaction;
• Seller - a company that sells goods presented on the Website;
• "Buyer" - an individual who has entered into an Agreement with the Seller on the terms set forth below;
• "Order" means the selection of individual items from the list of goods specified by the Buyer when placing an order and making payment.

3. Subject of the Agreement

3.1. The Seller undertakes to transfer the Goods to the Buyer's ownership, and the Buyer undertakes to pay for and accept the Goods on the terms of this Agreement. This Agreement governs the sale and purchase of goods in the online store, in particular:

• Voluntary selection of goods by the Buyer in the Online Store;
• The Buyer's independent placement of an order in the online store;
• Payment by the Buyer for the order placed in the Online Store;
• Processing and delivery of the order to the Buyer in accordance with the terms of this Agreement.

4. Ordering Procedure

• 4.1. The Buyer has the right to place an order for any product presented on the Website of the Online Store and available.
• 4.2. The item can be presented to the order in any quantity.
• 4.3. In the absence of goods in stock, the Company Manager is obliged to notify the Buyer (by phone or e-mail).
• 4.4. In the absence of goods, the Buyer has the right to replace it with goods of a similar model, refuse this product, or cancel the order.

5. Order Payment Procedure

• 5.1. Payment is made upon receipt of the goods at the branch of the transport company for cash in UAH.
• 5.2. In case of non-receipt of funds, the Online Store reserves the right to cancel the order.

6. Terms of Delivery

• 6.1. Delivery of the goods purchased in the Online Store is carried out to the warehouses of the transport companies where the orders are issued.
• 6.2. Together with the order, the Buyer is provided with documents in accordance with the legislation of Ukraine.

7. Rights and Obligations of the Parties

• 7.1. The Seller has the right to unilaterally terminate the provision of services under this Agreement in case of violation by the Buyer of the terms of this Agreement.
• 7.2. The Buyer is obliged to timely pay and receive the order on the terms of this agreement.
• 7.3. The Buyer has the right to place an order in the online store, execute an electronic contract, and require the Seller to fulfill the terms of this Agreement.

8. Responsibility of the Parties

• 8.1. The parties are responsible for non-fulfillment or improper fulfillment of the terms of this agreement in the manner prescribed by this agreement and the current legislation of Ukraine.
• 8.2. The Seller is not responsible for changes in the appearance of the Goods by the manufacturer; slight discrepancies in color due to monitor settings; content and accuracy of information provided by the Buyer; delays beyond control; unlawful actions by the Buyer; transfer of network identifiers to third parties.
• 8.3. The Buyer is solely responsible for any damage caused by his/her actions using the Internet access provided.
• 8.4. Force majeure events exempt the parties from fulfilling the terms of this Agreement.
• 8.5. The parties shall make every effort to resolve any disputes exclusively through negotiations.

9. Other Terms

• 9.1. The online store reserves the right to unilaterally amend this agreement subject to prior publication on the website pocketstore.com.
• 9.2. The online store was created to organize a remote method of selling goods via the Internet.
• 9.3. The Buyer is responsible for the accuracy of the information provided during ordering and consents to the collection and use of personal data in accordance with Ukrainian law.
• 9.4. Payment by the Buyer constitutes full acceptance of the public offer terms.
• 9.5. The actual date of the electronic transaction is the date of acceptance of the terms.
• 9.6. Using the online store to preview goods or place orders is free of charge.
• 9.7. Buyer information is confidential and used solely for order processing and delivery.

10. Return of Goods of Good Quality

• 10.1. Returns are carried out in accordance with Ukrainian law.
• 10.2. Return shipping is at the Buyer's expense.
• 10.3. Upon return of goods of good quality, the Online Store refunds the amount paid, minus delivery costs.

11. Term of the Agreement

• 11.1. An electronic agreement is considered concluded when the proposal is accepted according to the Law of Ukraine "On Electronic Commerce".
• 11.2. Before expiration, the Agreement may be terminated by mutual consent until delivery.
• 11.3. The Parties may unilaterally terminate the Agreement in case of non-fulfillment or as provided by law.

Please note that the online store "pocketstore.com" may grant the right to use the platform to individual entrepreneurs and legal entities for selling goods in accordance with Ukrainian law.
